Samuel C. Agwiak was charged with one count of sexual assault in the first degree and two counts of sexual abuse of a minor. Agwiak eventually pled no contest to one count of sexual abuse of a minor. The remaining charges were dismissed in return for the plea. Because Agwiaks offense occurred in 1982, it was a class C felony. See former AS 11.41.440. Presumptive terms of two and three years are prescribed for second and subsequent offenders convicted of class C felonies; there is no presumptive term for a first felony offender. AS 12.55.125(e). Superior Court Judge John H. Bosshard, III sentenced Agwiak, a first felony offender, to a term of three and one-half years with one year suspended. Agwiak appeals, contending that the sentence is excessive. We affirm.
